Terms of Service

These Terms of Service ("Terms") set forth the conditions for using MVV Insights ("the Site"). By using the Site, users ("Users") agree to comply with these Terms.

1. Application

These Terms apply to all relationships between Users and the Site regarding the use of the Site. The Site may establish additional rules regarding usage. Such rules shall constitute part of these Terms.

2. User Registration

Some services on the Site require Users to register. The Site will approve registration applications except in the following cases:

  • When false information is provided
  • When the applicant has previously violated these Terms
  • When the Site otherwise deems registration inappropriate

3. Management of User ID and Password

Users shall appropriately manage their User IDs and passwords for the Site at their own responsibility. Users may not, under any circumstances, transfer, lend, or share their User IDs and passwords with third parties. The Site shall consider any login using a matching combination of User ID and password as usage by the registered User of that User ID.

4. Prohibited Activities

Users shall not engage in the following activities when using the Site:

  • Activities that violate laws or public order and morals
  • Activities related to criminal acts
  • Activities that destroy or interfere with the functions of the Site's, other Users', or third parties' servers or networks
  • Activities that may interfere with the operation of the Site's services
  • Activities that collect or accumulate personal information about other Users
  • Unauthorized access or attempts thereof
  • Impersonating other Users
  • Activities that directly or indirectly provide benefits to antisocial forces in connection with the Site's services
  • Activities that infringe upon the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Site, other Users, or third parties
  • Other activities deemed inappropriate by the Site

5. Suspension of Service

The Site may suspend or interrupt all or part of the Site without prior notice to Users if it determines that any of the following circumstances exist:

  • When performing maintenance or updates to the Site's systems
  • When the provision of the Site becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  • When computers or communication lines are stopped due to accidents
  • When the Site otherwise determines that provision of the Site is difficult

The Site shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the Site.

6. Copyright

Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise allow third parties to use or provide information obtained through the Site without prior consent from the Site.

7. Disclaimer of Warranty and Limitation of Liability

The Site does not expressly or impliedly warrant that the Site is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, rights infringement, etc.).

The Site shall not be liable for any damages incurred by Users arising from the Site, except in cases of intentional or gross negligence on the part of the Site. However, this disclaimer shall not apply if the contract between the Site and the User constitutes a consumer contract as defined by the Consumer Contract Act.

8. Changes to Service Content

The Site may change the content of the Site or discontinue the provision of the Site without notice to Users. The Site shall not be liable for any damages incurred by Users due to such changes.

9. Changes to Terms of Service

The Site may change these Terms at any time without notice to Users if deemed necessary. Continued use of the Site after changes to these Terms shall be deemed as consent to the revised Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by Japanese law. Any disputes arising in connection with the Site shall be subject to the exclusive agreed jurisdiction of the court having jurisdiction over the location of the Site's head office.
